Terms of service

1. Provider

These terms apply to services provided by SoftCode Piotr Nowacki, NIP: 6482058477, address: Górnicza 67c, 42-600 Tarnowskie Góry, Polska, website: https://softcode-ai.pl.

2. Nature of services

Services may include analysis, design, development, integration, deployment and maintenance of websites, web applications, administrative panels, client portals, API integrations and intelligent functions supporting company workflows.

Information presented on the website is for informational and marketing purposes. It does not automatically constitute a binding legal offer unless explicitly agreed otherwise.

3. Scope, offer and pricing

Each project is assessed individually. Scope and pricing depend on the business goal, workflow complexity, required modules, integrations, user roles, security requirements, data availability and support needs.

Specific deadlines, responsibilities, payment model and maintenance rules are defined in an offer, email confirmation, project agreement or separate contract.

4. Client responsibilities

• The client provides accurate, current and complete information needed to deliver the service.
• The client confirms that they are authorised to use all systems, accounts, data, files, content, materials and credentials shared for the project.
• The client should provide required access, API authorisations, documentation, test data or approvals when they are needed for delivery.

5. External services and integrations

Integrations with platforms such as e-commerce systems, CRM, payment providers, social media, TikTok, Meta, courier services or communication tools are implemented only for client-owned or client-authorised accounts and systems.

SoftCode is not responsible for outages, API changes, account restrictions, moderation decisions, authorisation problems or access refusals caused by third-party platforms.

6. Testing and deployment

Web applications, integrations and intelligent features should be tested before production use. The client verifies whether the delivered solution works correctly in their own business process.

Deployment may be carried out in stages to reduce risk and avoid disruption to existing operations.

7. Fees and project changes

Fees may be agreed as a fixed price, milestone-based payment, recurring support model or mixed model.

New requirements, additional functions, extra integrations or changes to the original concept may require an updated timeline and valuation.

8. Confidentiality and security

Technical, organisational, commercial, access-related and business information shared by the client is treated as confidential where its nature indicates it should not be publicly disclosed.

Access credentials, API tokens, keys, configuration files and information about client systems are used only to perform the agreed service.

9. Intellectual property

Code, designs, configurations, workflows, documentation and other project deliverables may be protected by copyright or other intellectual property rights.

The transfer of rights, licence scope or usage rights is agreed individually. Unless agreed otherwise, the client receives the right to use the delivered solution for their own business operations.

10. Liability limits

SoftCode uses reasonable care when delivering services, but does not guarantee uninterrupted operation of third-party APIs, AI providers, hosting, social platforms, payment systems or other external infrastructure.

Business decisions, client content, use of the system inside the client organisation and compliance with laws or platform rules remain the client’s responsibility.

11. Ending cooperation

Rules for ending cooperation are agreed per project. After cooperation ends, the client should revoke credentials, tokens and authorisations that are no longer needed.

Upon request, SoftCode may delete integration-related data unless further storage is required by law or necessary to protect legitimate claims.
